(Additional provision 7th of Law 3/2023, on fiscal, financial, administrative and public sector measures for 2023)
The Independent Whistleblower Protection Authority in Catalonia is the Anti-Fraud Office of Catalonia. Its designation, both with regard to the public and private sectors, is established by the seventh additional provision (Protection of persons who report breaches of law) of Law 3/2023, of March 16, on fiscal measures , financial, administrative and public sector for 2023 (DOGC no. 8877, of 17.03.2023), with the following content:
- Until regulations are deployed on the protection of people who report breaches of law in the public sector of Catalonia, the Anti-Fraud Office of Catalonia is assigned the functions that, in accordance with the State Law 2/2023, of February 20, regulating the protection of people who report on regulatory violations and the fight against corruption, correspond to the competent institutions or bodies of the autonomous communities.
- It is up to the person in charge of the management of the Anti-Fraud Office of Catalonia to issue a resolution and adopt provisional measures in the procedures for exercising the sanctioning power established by State Law 2/2023, and proceed to the enforcement of sanctioning resolutions, with the collaboration, if necessary, of the Administration of the Generalitat (Catalan Government) and the rest of the public administrations. The corresponding procedures must be followed in accordance with the principles of the laws governing the legal regime of the public sector and the common administrative procedure and subject to their rules of procedure.
- The Government must promote the drafting of a Catalan law on the protection of people who report breaches of law.
