(Articles 24, 41 and 61)
The scope of the powers of the Authority in Catalonia (Anti-Fraud Office), within the framework of Law 2/2023, is specified in the following articles:
- article 24, regarding processing, through the external channel. In this sense, it will be (section 2, letter c)) with respect to the information that affects entities that are part of the private sector, when the non-compliance communicated is circumscribed to the territorial scope of the corresponding autonomous community.
- article 41, regarding the provision of support measures. In this sense, it will be, with regard to the scope of the private sector, when the non-compliance communicated is limited to the territorial scope of the corresponding autonomous community.
- article 61, regarding the exercise of sanctioning power. In this sense, it will be, in accordance with section 3, if the regional regulations have provided for its competence in relation to the infractions committed in the field of the private sector when they only affect its territorial scope.
