Sunyer Town Council

December-2023

The Anti-Fraud Office has examined, following a report, a possible favorable treatment in the awarding by the council of two works, initially, to two different companies, using the minor contract modality in order to avoid, presumably , the tender that would correspond to the characteristics of the work as a whole. From the documentation examined, no objective motivation has been found for the division of the works into two independent projects and the following has been verified: the two files have been processed absolutely simultaneously in their preparation phases, bidding, awarding and formalization; present a temporal and spatial coincidence in terms of the scope of action envisaged in one of the work projects and the scope corresponding to an action area of the other, as well as an intrinsic relationship between the works envisaged in one of the work projects and those defined for a certain area of action in the other project. It has also been noted possible links between the companies awarded the two minor works contracts (one of them is 100% controlled by the other), as well as the existence of indications of protection offers in all two recruitment files.
