The purpose of this action is to determine the existence of an alleged favorable treatment by the Town Council to a service company for the fact of allowing the use of municipal equipment disregarding the legally established procedure and without the relevant liquidation of the municipal private use rate. The investigative actions found that the council would not only have carried out a contractual activity by way of de facto, without the processing of any type of procedure, but that this irregular action would have been carried out deliberately and consciously, ignoring the warnings made by municipal comptroller secretary regarding the illegality of signing a collaboration agreement, in violation of public procurement regulations and the principles of competition, publicity and transparency. The case we are dealing with would involve an assumption of cause of nullity of the aforementioned agreement.
