The purpose of the investigation was to analyze the alleged favorable treatment by the City Council towards a public employee who, after occupying a certain position under the service commission regime, was appointed again, at the end of this commission, for the same position and occupied another, newly created, through a modification that could violate the principles of merit and capacity in access to public service. After analyzing the facts, it was considered that the appointments of this person, granted in the service commission, were contrary to the civil service regulations. However, the last commission of services awarded to this person at the workplace, at the time of closing the investigation, is finished. Therefore, it was agreed to archive with communication to the council, which is responsible for assessing the opportunity to initiate an ex officio review procedure based on the absolute nullity of the appointments of the service commissions.
