After receiving a report, the alleged favoritism related to the appointment of a member of the local police linked to their selection process has been investigated. Despite the incidents detected in the investigative actions, according to the report, these are facts that could be traced back to almost thirteen years ago. In the present case, it is necessary to weigh both the seriousness of the facts analyzed, in application of the principle of legality and the regulations for access to the public service, as well as the age of the detected irregularities and the effective provision of services. Also, in this case, it is necessary to attend to and modulate the effects of a possible nullity of the acts affected with the concurrence of other legal principles such as legal certainty, proportionality, fairness and good faith and legitimate trust. Taking into consideration the time that has passed, the nature of the detected irregularities and the principles of legal certainty, proportionality and fairness, it is considered appropriate to archive this action.
