After receiving a report, possible favorable treatment by the council in the awarding of service contracts to a business was examined. Once the investigative actions have been completed, it is concluded that the provision of the contracted service was carried out in violation of the essential rules established in the Public Sector Contracts Act (LCSP), in a frontal and obvious way. Thus, it has been possible to verify irregular fractionation of the object of the contract, which has meant a violation of the principle of competition and transparency, required in public tendering, and of the principles of publicity, equality between bidding companies and efficiency recognized at the LCSP. The legal effect of this evidenced illegality would be the nullity of the affected contracts.
