Olèrdola Town Council

March-2022

On the occasion of a report, some agreements adopted by Olèrdola Town Council have been examined which may constitute an illegal use or destination of public funds, since they have as their object the rescheduling of expenses of a private nature, such as civil liability, professional and legal defense insurance taken out by municipal officials in a private capacity. It may be appreciated that all officials to whom the amount has been paid for insurance of this nature, either by the grant of an extraordinary gratuity or direct payment, or by taking out a policy, they would have received remuneration to which they were not legally entitled. The municipal corporation points out that the investigated payments would be protected by the pacts and agreements negotiated collectively by Olèrdola Town Council to regulate the working conditions of the corporation's official staff. In this case, being the subject of both doctrinal and jurisprudential controversy, the action under investigation is reduced to a matter of mere ordinary legality without any evidence of corruption being identified.
