El Masnou City Council

July-2024

The investigation aimed to determine whether several appointments and hirings made by El Masnou City Council were carried out without any kind of public competition and without some of the people appointed or hired having the necessary training or qualifications, taking into account that the majority of these people would have family ties with a position of responsibility at El Masnou City Council. The Anti-Fraud Office analyzed the possible concurrence of a conflict of interest that would fall on the aforementioned position, derived precisely from a family relationship with the majority of the people hired, and it was able to prove that he did not participate in any of the qualifying tribunals of the selective processes analyzed, nor did he participate in carrying out the tests or in their assessment. However, this Office considers it necessary to remind El Masnou City Council of the obligation to strictly comply with the duty of abstention in the ordinary exercise of the functions assigned to the specific job position being developed, regulated in Law 40/2015, on the legal regime of the public sector, and which constitutes an ethical principle for public employees established in the basic civil service regulations.
