The purpose of this investigation was to analyze: (i) the subsidies allegedly granted to Margalef Town Council to finance a series of construction contracts; (ii) the possible falsification of invoices by specific companies so that the Town Council could be the beneficiary of aforementioned subsidies, and (iii) the existence of a possible conflict of interest between those companies and the Town Council of Margalef. With respect to the first point, there is reasonable suspicion regarding the improper use of part of the funds intended for one of the works that would have supposedly been used for another purpose. As for other works, there is no doubt about their completion, but there is doubt about the legality of the award procedures used, and the correct application of the principles of equality, transparency and free competition. With regard to the possible falsification of invoices, the facts described are not substantiated in any way and it has not been possible to prove any type of irregularity, nor has it been possible to obtain any evidentiary element that could prove the existence of conflicts of interest or favorable treatment on the part of the contracting body towards the aforementioned companies. Consequently, it was agreed to archive the action with the communication of the irregularities and deficiencies noted.
