Following a complaint about a possible breach of the incompatibilities regime for senior officials of the Generalitat, the action examined the incorporation, the month following his resignation, of the person who had held the general management of Generalitat de Catalunya Railways (FGC) into a business group that had been awarded several public contracts tendered by FGC during his term of office. Specifically, it was analyzed whether this incorporation could violate the prohibition on intervening in private activities linked to decisions adopted during the exercise of the position. In the investigation actions carried out, signs of irregularity were observed in the failure to consider this position as a senior position for the purposes of the incompatibilities regulations, as well as in the failure to review and adapt his employment contract. Irregularities and inconsistencies have also been detected in certain procedures for awarding FGC contracts, which would have been awarded, directly or with little competitive competition, to companies in the same group. For this reason, the action has ended with the transfer of the facts and actions to the General Intervention of the Generalitat and the Secretariat of Administration and Public Function, as competent bodies in matters of financial control, inspection and supervision of the public sector.
