The purpose of this investigation has focused on analyzing several minor contracts, specifically 20, awarded by the Cubelles Town Council for an amount of 427,000 euros, between May 2019 and June 2022, and, derived from this, the possible existence of alleged preferential treatment by aforementioned corporation towards a specific entrepreneur and the companies in which said entrepreneur is the administrator and sole partner. This Office has found, as a result of the actions taken, that there are sufficient indications to consider the occurrence of preferential treatment by the Cubelles Town Council towards the entrepreneur under investigation. With regard to the contracts analyzed, this Office considers the following irregularities to be proven: (I) a prohibited division of the object of the contract in order to evade the publicity of the procurement procedure that should have been processed; (II) a fraudulent action consisting of simulating the public competition of three different bids to comply with the provisions of the budget execution bases, and (III) finally, the lack of essential documents in the administrative file. And what would be most serious is that it would appear that these irregularities would have occurred with the aim of favoring a single entrepreneur.
