The object of the present action revolves around, on the one hand, the possible irregularities in the subcontracting, of the Sagrad Cor and Sant Rafael Hospitals, of the rehabilitation and speech therapy services, as well as the eventual lack of control of the Catalan Health Service (CatSalut) regarding these irregularities, and, on the other hand, a possible conflict of interest between a member of the CatSalut Board of Directors and the subcontracted company. It has been established that CatSalut, through its specialized units, has inspected the two aforementioned hospitals and has instituted separate disciplinary proceedings on the subcontracting of rehabilitation and speech therapy services for the commission of a serious offence. Therefore, it must be ruled out that the irregularities in the referred subcontracting have not been detected and managed by the Department of Health, on the contrary, they have even been subject to sanctions. It is also necessary to rule out the possible conflict of interest given that the affected person ceased to be a member of the CatSalut Board of Directors before the agreements between the two hospitals and the outsourced company were signed.
