As a result of a report, an investigation has been carried out into possible favorable treatment by the council to a business for the successive awards of a service contract, for the municipal permissiveness towards the breaches of the aforementioned business and for the payment, to the same company, for amounts that are not justified by the corresponding work certifications. From the investigative actions, it is clear that the debt recognition agreement signed between the successful company and the Town Council, and which is adduced as justification for the retention by the company of fees that it has stopped liquidate at the Town Council, would be vitiated by full legal nullity, given that it would involve the assumption of an expenditure commitment without the prior existence of adequate and sufficient budget appropriations. This is why the Anti-Fraud Office requests the Town Council to initiate the corresponding ex officio review procedure regarding this act.
