The object of the present action is focused on an alleged treatment of favor of an elected position of the l’Aldea Town Council towards a family member, in the recruitment to cover several jobs in the council. From the actions of the Anti-Fraud Office can be seen that the first recruitment is duly justified, as well as the subsequent internships. Although they should have been the result of a selective public process, they had a very short duration in time to respond to specific needs. This practice has not been repeated by the local corporation, neither in the person affected nor in the method, on the contrary, since several calls have been made in order to set up job boards in order to provide needs surpluses of the local administration. On the other hand, from the information obtained on the management of the three recruitments, put in relation to the responsibilities and actions of the affected elected office, his presence in the council was no longer a mere risk that did not entail the need to make use, for example, of the institution of abstention, nor has it represented the finding of the existence of an irregular action. The action ends with a filing resolution.
